Family Sponsorship – Who Can Apply?

One of the questions we have been asked most frequently is “Can my family in Canada sponsor me and my family for immigration?”.

Depending on your relationship you can be sponsored under the Family Class.

In order to be eligible you need to have a Canadian sponsor living in Canada who is at least 18 years of age and is your:

  • Spouse / Common-Law Partner / Conjugal Partner
  • Parent (including adoptive parents)
  • Child
  • Grandchild
  • Brothers, sisters, nephews, nieces, or grandchildren who are orphaned, are under 18 and do not have a spouse or common-law partner

A Canadian Citizen or Permanent Resident can also sponsor any one relative to Canada, regardless of age, but only if they do not have a living relative who is one of the following AND they do not have any other living relatives who are a Canadian Citizen, Canadian Permanent Resident or a Registered Indian:

  • Your spouse/common-law/conjugal partner
  • Your child
  • Your parent
  • Your grandparent
  • Your sibling
  • Your aunt or uncle

If the sponsor in Canada has a living relative who is any of the above, OR they have a living realtive who is a Canadian Citizen, Canadian Permanent Resident or a Registered Indian then they cannot sponsor you to Canada unless you are their:

  • Spouse/common-law/conjugal partner
  • Child
  • Parent
  • Grandparent

If you are applying under the Federal Skilled Worker Stream you can earn additional points for having realtives in Canada. If you have any of the following family members physically living in Canada who are related to you by blood and are Canadian Citizens or Canadian Permanent Resident and are 18 years of age or older, you can earn an additional 5 points on your Federal Skilled Worker Score. They will not add any additional points to your Comprehensive Ranking System Score.

  • Parent
  • Grandparent
  • Child
  • Grandchild
  • Sibling
  • Aunt / Uncle
  • Niece / Nephew

If you are already in the Express Entry Pool, having family in Canada can assist you when applying under certain Provincial programs.

Each program is unique, but you may earn additional points for having friends or family (including distant relatives) residing in that specific province which could increase your chances of being selected for a Provincial Nomination.
